It was the apex court’s judgment on Right to Privacy earlier this year which started the process of revisiting the 2013 verdict upholding Section 377 of the Indian Penal Code (IPC). In its judgment, it said that the Right to Privacy and the protection of sexual orientation lie at the core of the fundamental rights guaranteed by Articles 14, 15 and 21 of the Constitution. It had noted that sexual orientation was an essential attribute of privacy and that discrimination on the basis of sexual orientation is deeply offensive to the dignity and self-worth of the individual.

Justice DY Chandrachud in his judgment said that gays, lesbians, bi-sexual and transgenders have equal rights as other citizens. Further he said that this case is much more than just decriminalizing a provision. It is about an aspiration to realise Constitutional rights and equal existence of LGBT community as other citizens. To deny LGBT community of their right to sexual orientation is a denial of their citizenship and a violation of their privacy, Justice Chandrachud added, while stressing that they cannot be pushed into obscurity by an oppressive colonial legislation. Treatment of homosexuality as a disorder/ disease has a severe impact on mental health of such persons. Decriminalization is but the first step, said Justice Chandrachud. He also adds that the Constitution envisages much more. LGBTs have been a victim of Victorian morality. The Constitutional morality and not Societal morality should be the driving force for deciding validity of Section 377. Reiterating his stand, Justice Chandrachud said that the LGBT community is entitled to equal citizenship, equal rights under the Constitution.
